Hadi's Autorickshaw Driver Gives Spontaneous Statement

Md. Kamal Hossain (46) who was driving the auto-rickshaw carrying Sharif Osman Hadi during the armed attack on him has given his statement in the court here today as a witness.

Hadi, an independent candidate in the 13th National Parliamentary Election and convener of Inqilab Mancha, was fired from a point blank range in city’s Box Culvert Road under Palton Police Station on December 12 while traveling by an auto rickshaw towards Suhrawardy Udyan from Motijheel area.

Kamal Hossain was produced before the Chief Metropolitan Magistrate (CMM) Court today by Investigating Officer of the case, DB Inspector Faisal Ahmed and he prayed for recording the statement of Kamal as a witness. 

Following the petition, Metropolitan Magistrate Jamshed Ahmed on behalf of the CMM recorded his statement under section 164 of the criminal procedure code (CrPC).

The IO in his petition stated that on December 12, on the paved road in front of DR Tower on Box Culvert Road under Paltan Model Police Station, in the direction of Bijoynagar Water Tank, accused Faisal Karim Masud alias Daud, who were on a motorcycle following from behind, along with their unidentified associates, shot Hadi with a firearm. Injured Hadi was first taken to Dhaka Medical College Hospital for treatment and later to Evercare Hospital. 

As his physical condition deteriorated, he was taken by air ambulance to Singapore for better treatment and admitted to Singapore General Hospital. He later died on December 18 while undergoing treatment there. 

The case is a sensational murder case. At the time of the incident, Hadi was traveling by the auto rickshaw driven by witness Md. Kamal Hossain (46) from Motijheel, towards Suhrawardy Udyan, when he was shot at the scene. 

Kamal Hossain is an eyewitness. The witness is willing to voluntarily give his statement in court. For the sake of proper investigation of the case, it is essential to record the witness’s statement under Section 164 of the Criminal Procedure Code (CrPC).

On December 12 at about 2:20 pm, miscreants shot at Hadi on Box Culvert Road under Paltan Police Station and fled. In connection with the incident, on December 14, Abdullah Al Jaber, member secretary of Inqilab Mancha, filed a case at Paltan Police Station alleging attempted murder. 

Charges were brought against the accused under sections 120(B)/326/307/109/34 of the Penal Code. Later, on December 20, following an application by the investigating officer, Dhaka Metropolitan Magistrate Siddiq Azad ordered to add section 302 (murder) of the Penal Code to the case.
