The United States has introduced a new restriction under the Trump administration, declaring that visas will not be issued to applicants who intend to give birth in the country to secure citizenship for their children. The move comes amid months of tightened visa regulations.
Many foreign nationals travel to the US as tourists with the aim of delivering babies there, since the 14th Amendment guarantees birthright citizenship to children born on American soil. The US Embassy in India announced on X that if consular officials believe a traveler’s primary purpose is to give birth in the US for citizenship benefits, the visa application will be rejected. The post added that the policy aims to prevent tourism visas from turning into a pathway for “birth tourism.”
Under US immigration law, any child born in the country automatically becomes a citizen, a provision often used by foreign visitors arriving on travel visas. The new rule seeks to close that loophole.
The US has also expanded social media and online screening for H-1B skilled worker applicants and their H-4 dependents. Embassy officials said applicants will be approved only when they pose no security risk and meet all eligibility requirements.
